Welcome to the Papa Bear Daycare website (the “Site”). These Terms & Conditions (“Terms”) govern your use of our Site and participation in our SMS messaging program. By accessing our Site or opting in to receive SMS messages, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use our Site or our childcare services.

1. Company Information
Papa Bear Daycare (“we,” “our,” or “us”) provides childcare services, early childhood education, enrollment coordination, and family communications, including SMS messaging for daily updates, emergency alerts, billing reminders, and appointment scheduling.

2. SMS Messaging Program

2.1 Opt-In Method
You opt in to our SMS program by checking a box on our contact/enrollment form at https://papabeardaycare.com/contact or by providing your phone number during in-person enrollment, thereby agreeing to receive SMS messages from us..

2.2 Message Types
By providing your phone number and agreeing to receive texts, you consent to receive:

• Daily childcare updates (e.g., naps, meals, activities)
• Emergency or safety alerts (e.g., center closure, illness notification)
• Billing and payment reminders
• Appointment scheduling texts (e.g., pick-up/drop-off changes, parent-teacher meetings)

These message types match those described in our Privacy Policy and SMS registration.

2.3 Message Frequency & Charges

• Message frequency varies; no more than 6 messages per month (excluding urgent safety communications).
• Message & data rates may apply. Check with your mobile carrier for details.

2.4 Opt-Out & Help

• Reply STOP to unsubscribe from non-emergency SMS messages at any time.
• Reply HELP for assistance.
• Note: Opting out of SMS may limit our ability to send you time-sensitive childcare notifications.

2.5 Data Privacy

3. Use of the Site
You agree to use our Site only for lawful purposes related to childcare enrollment and family communication. You may not:

• Violate any applicable laws or childcare licensing regulations.
• Attempt to gain unauthorized access to our systems.
• Use the Site to transmit spam, malicious code, or harmful content.
• Submit false or misleading information about a child’s health, emergency contacts, or legal custody arrangements.

4. Enrollment & Service Terms

• Enrollment is subject to separate enrollment agreements, including tuition policies, immunization requirements, and pick-up/drop-off rules.
• In the event of a conflict between these Terms and your enrollment agreement, the enrollment agreement controls.
• We reserve the right to refuse service or terminate enrollment for violations of our center policies or these Terms.

5. Intellectual Property
All content on this Site, including text, graphics, logos, educational materials, and images, is the property of Papa Bear Daycare or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our written permission.

6. Third-Party Links

7. Disclaimer of Warranties

8. Limitation of Liability
To the fullest extent permitted by law, Papa Bear Daycare shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or our SMS program. Our total liability shall not exceed the amount you paid us for childcare services in the preceding three months.

9. Indemnification
You agree to indemnify and hold Papa Bear Daycare harmless from any claims, damages, or expenses arising from your violation of these Terms, misuse of the Site, or failure to provide accurate health or emergency information about your child.

10. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. For material changes, we will notify you via SMS or email.

11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the state where Papa Bear Daycare operates, without regard to conflict of law principles.
